1  Right of Withdrawal

1.1
If you are a consumer (i.e. a natural person placing the order for purposes that are predominantly outside your trade, business or profession), you are entitled to a statutory right of withdrawal.

Your right of withdrawal is governed by the conditions outlined below:

You have the right to withdraw from this contract within fourteen (14) days without giving any reason.

The withdrawal period is:

a) If you have ordered goods: fourteen (14) days from the day on which you or a third party named by you (other than the carrier) have taken possession of the goods.

b) If you have ordered services: fourteen (14) days from the day the service contract was concluded (unless we have already started performing the services as agreed with you — in that case, you cannot withdraw from services that have already been rendered).

To exercise your right of withdrawal, you must notify us (Volkswagen Group Charging GmbH, Karl-Liebknecht-Str. 32, 10178 Berlin, via the Elli contact form, Tel.: 0800 – 35541111*, or by sending a clear statement, e.g., by letter, fax or email) of your decision to withdraw from the contract.
You may use the sample withdrawal form available for download, although this is not required.
Alternatively, you can complete and submit the withdrawal form or another clear statement electronically via our website: https://shop.elli.eco/. If you use this option, we will send you an immediate confirmation of receipt of such withdrawal (e.g. via email).

To meet the withdrawal deadline, it is sufficient to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

a) If you withdraw from this contract (and we have not yet started to perform any services as agreed), we will refund all payments we have received from you, including (if applicable) standard delivery charges, without undue delay and at the latest within fourteen (14) days from the day on which we received your notice of withdrawal.
We will not refund any additional costs arising from your choice of a delivery method other than our standard delivery option.

b) If you withdraw from a contract for services that we have already started providing during the withdrawal period, you will be required to pay for the services already rendered. If you have paid the full amount in advance, we will refund you the portion corresponding to services not yet provided — no later than fourteen (14) days from the date we received your notice of withdrawal.
Once the services have been completed (even within the withdrawal period), your right of withdrawal no longer applies.

c) We will refund you using the same payment method you used in the original transaction, unless expressly agreed otherwise with you. In no case will you be charged fees for the refund. We may withhold the refund until we have received the goods back or you have provided proof of having returned them — whichever is earlier.

d) If you have ordered goods, you must return them without delay and in any case no later than fourteen (14) days from the date you informed us of the withdrawal to:

The deadline is met if you send the goods before the end of the fourteen-day period.
You bear the direct cost of returning the goods.
You are only liable for any loss in value of the goods if this loss is due to handling beyond what is necessary to examine the nature, characteristics, and functioning of the goods.
